Welcome to Precious Caring (“we,” “our,” or “us”). By accessing and using our website at https://preciouscaring.com.au (the “Website”) and/or engaging our disability support services (the “Services”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Website or Services.

2. Description of Services

Precious Caring is a registered NDIS provider that offers person-centred disability support services, including but not limited to: daily personal care, community participation, specialised complex care, and supported independent living (SIL). All Services are delivered in accordance with the National Disability Insurance Scheme (NDIS) standards and guidelines.

3. Service Agreements

Formal engagement of our Services requires a separate, written Service Agreement. These Terms and Conditions govern general use, while specific terms of service delivery, schedules, fees, and responsibilities will be detailed in your individual Service Agreement, which will take precedence.

4. Eligibility & Account

To receive our Services, you must:

  • Be an NDIS participant with an approved plan that includes funding for the relevant support categories, OR make private arrangements.
  • Provide accurate and complete information during the intake and assessment process.
  • Have the legal authority to enter into an agreement for services.

5. Fees, Payments & NDIS Funding

  • Our fees are set in accordance with the current NDIS Price Guide for registered providers.
  • For NDIS participants, we will claim payment directly from the NDIS portal (for NDIA-managed plans) or invoice your nominated plan manager. Self-managed participants will receive invoices for payment.
  • For privately funded services, payment terms will be specified in your Service Agreement.
  • You are responsible for ensuring your NDIS plan has sufficient funds to cover the agreed supports.

6. Cancellations & Changes

  • We require a minimum of 24 hours’ notice for cancellation of a scheduled support session. Late cancellations or missed appointments (with less than 24 hours’ notice) may be charged at the full rate, subject to NDIS rules and your Service Agreement.
  • You may request changes to your support plan by contacting your assigned coordinator. Changes are subject to availability and may require an updated Service Agreement.

7. Your Responsibilities

You agree to:

  • Provide a safe working environment for our staff.
  • Treat our staff with respect and dignity.
  • Provide timely and accurate information necessary for your care.
  • Notify us immediately of any changes to your NDIS plan, health, or circumstances.

8. Our Responsibilities

We agree to:

  • Provide Services with reasonable care, skill, and professionalism.
  • Employ qualified and screened support workers.
  • Comply with all applicable laws, including the NDIS Code of Conduct and Practice Standards.
  • Maintain appropriate insurance.

9. Limitation of Liability

To the maximum extent permitted by law, Precious Caring shall not be liable for any indirect, incidental, or consequential damages arising from your use of our Website or Services. Our total liability for any claim related to the Services is limited to the amount paid by you or your plan for the specific support in question.

10. Intellectual Property

All content on this Website, including text, graphics, logos, and images, is our property or licensed to us and is protected by copyright laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

11. Privacy

Your privacy is important to us. All personal and health information collected is governed by our separate Privacy Policy, which forms part of these Terms and Conditions.

12. Termination

We or you may terminate the Service Agreement by providing written notice as per the terms outlined in that agreement. We reserve the right to suspend or terminate access to our Website or Services immediately if you breach these Terms and Conditions.

Our Website may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites.

14. Governing Law
